Terms and conditions

The following terms of sale and delivery apply to all distance-selling deliveries from the webshop BoatLab, CVR no. 27331939, to private consumers. In the case of sales to companies, dealers, and other business customers (B2B), the relevant provisions in accordance with Danish law apply at all times. For purchases in a physical store, the applicable rules in accordance with Danish law also apply. The terms apply in cases where no other written agreements have been made between you as the buyer and BoatLab.

Documentation and instructions
If product descriptions and user manuals exist for the item, these are included with the delivery from BoatLab.dk. If you want further information or advice from BoatLab.dk, this is of a guidance nature.

Legislation
BoatLab.dk would like to point out that some of the goods for sale in the store are illegal, according to Danish law, to use/have in public places/on public roads. These goods are for exhibitions/track driving/driving abroad (not Danish registration). If you are in doubt, please contact the local authorities. BoatLab.dk cannot be held responsible for any violations/fines.

Delivery time and transport
Delivery of goods from BoatLab.dk is deemed to have taken place when the consumer has received the goods. Shipment of goods takes place by Post or carrier if otherwise not agreed in advance. Normal delivery time is 1-3 business days. Please note that some goods are "not in stock" or specially made; for these goods, the delivery time may exceed the normal delivery time. On the website, our delivery times are estimated and updated to the best of our knowledge. Contrary to expectations, delivery times longer than those described on the website may occur.

Shipping

Free shipping option for GLS parcel shop parcels for private customers on purchases over 1000,- kroner.

GLS Private with delivery costs 59,-
GLS Business with delivery costs 59,-
Volume parcels cost up to 769,-
Handling surcharge for orders under 200kr costs 19,-

Parcels are sent with GLS to the specified delivery address. All parcels are sent as insured goods and with Track & Trace.

If you are not at home when delivery is made to a private address, the parcel must subsequently be collected from the nearest GLS parcel shop. You will receive further notice from GLS by email and/or SMS.

These terms apply to shipments in Denmark to islands connected by bridge. Separate shipping rates apply to international parcels.

Risk for the goods
The risk for goods purchased from BoatLab.dk passes to you as the consumer when the goods are collected at our address by you, or when you take physical possession of the goods.

Complaint
When you shop at BoatLab.dk, you of course have a 24-month right of complaint. This means that you can either have the item repaired, exchanged, refunded, or receive a price reduction, depending on the specific situation. Of course, it is a requirement that the complaint is justified and that the defect has not arisen as a result of incorrect use of the product or other damaging behavior.


Any errors or defects in delivery from BoatLab.dk must be reported within a reasonable time after you have discovered the error. If you complain within two months after the defect is discovered, the complaint will always be timely. It is your duty to state and, upon request, show how the error or defect manifests itself. If you discover an error, you must contact BoatLab.dk as soon as possible. As a rule, you can only complain about defects that appear no later than two years after you have received the item. For goods with a limited shelf life or lifespan (e.g. bulbs, neon tubes, etc.), your right to complain is limited to the item's normal lifespan.

If the complaint is justified, we will refund your (reasonable) shipping costs. The item must always be returned in proper packaging, and remember to obtain a receipt for the shipment so that we can reimburse your shipping costs. Please note that we do not accept packages sent cash on delivery or without delivery.

Defects

If you want to complain about your purchase, please contact info@BoatLab.dk. If it is not possible to find a solution, you can submit a complaint to the relevant board in the area, provided that the conditions for this are met.

To be able to file a complaint with Nævnenes Hus, the item or service you wish to complain about must have cost at least 1,110 DKK and no more than 100,000 DKK.

Warranty
BoatLab.dk provides no independent warranty. If the products are covered by a warranty, it is solely the warranties offered by the manufacturer. All inquiries regarding warranty must therefore be directed to the manufacturer of the product.

Age
You must be 18 years of age or older to shop on BoatLab.dk. By approving the order, the buyer confirms that they are over 18 years old or have parental consent.

Product liability
BoatLab.dk is liable for product liability in accordance with the legislation applicable at any time in this regard, but does not assume liability to any greater extent than what follows from the law.

Order
You can only shop through our website, BoatLab.dk, as our warehouse is not located at the address. If you have inquiries about items that are not on the site, you are welcome to contact us by phone or email. When you shop on BoatLab.dk, agreements are made in Danish. It is possible to view previous orders by logging in on the website. If you want to receive a copy of your order confirmation, you must send an email to info@BoatLab.dk.

Price and payment
All prices include VAT and other taxes. Prices are current prices. In the event of delays, backorders or sold-out items, we strive to inform you as soon as possible and explain what we can do about it - for example, refund your money or help you find a similar item elsewhere. If a price is obviously incorrect, and you reasonably should have noticed this, we are not obliged to deliver the relevant product at the incorrect price.

A payment/card fee is associated with the use of the different payment methods. The fee for using the respective payment cards and methods is stated in parentheses.

If you pay with an international payment card (VISA, MasterCard), the amount is reserved immediately.
The money is reserved on your card or account until:
1) we charge the amount when we send the item, or 
2) the money is released according to the agreement with your card issuer. 

The money is reserved for 30 days by default, after which the reservation is automatically cancelled. However, you can contact your bank with documentation that the purchase has been cancelled, so they can remove the reservation early.

Sales by invoice require approval; we reserve the right not to offer credit or sell by invoice without further justification.

All prices include VAT. For specially manufactured products, BoatLab.dk reserves the right to require prepayment. BoatLab.dk reserves the right to change prices and information without prior notice.

Information regarding promotions and sales
The item is only reserved for you when your order has been completed and payment details have been registered in our system.
So do not wait too long from placing items in your basket to completing your order, as you risk that the item you have set your sights on may be sold out before you manage to complete your order.

Right of withdrawal for online purchases
The right of withdrawal expires 14 days after the day you:
1/ have received your item
2/ receives the last item into physical possession, in the case of an agreement for several different items that are ordered in one order and delivered separately.
3/ receives the last batch, or the last part, into physical possession, in the case of an agreement for delivery of an item consisting of several batches or parts.
4/ receives the first item into physical possession, in the case of agreements for regular delivery of goods over a specified period.

Within 14 days of receipt, you must notify us that you wish to cancel your purchase. The notification must be sent by email to info@BoatLab.dk. In your message, you must clearly inform us that you wish to exercise your right of withdrawal; you may also choose to use our standard withdrawal form and send it with the return. You can find it here.

You CANNOT withdraw simply by refusing to accept the package. If you choose to do so anyway, you must cover the costs we incur for returning the item to us. 

The right of withdrawal does not apply to specially made goods, such as custom-made goods produced at the customer’s request, and goods that are cut/trimmed and sold by the running metre. These are non-returnable and cannot be cancelled, returned or exchanged once ordered.

Safety equipment with approvals (e.g. TÜV, ISO) must be returned to the manufacturer for testing and repackaging.

Condition of the item and packaging upon return

You are only liable for any reduction in the item’s value resulting from handling other than what is necessary to determine the item’s nature, characteristics and how it functions.

The item must be returned in its original packaging, including any inserts, manuals, accessories and protective materials, provided that the original packaging was delivered with the item and is still in the customer’s possession. Original packaging is considered part of the item when it affects the item’s commercial value.

If the original packaging is not available, the item must be returned in other equivalent suitable packaging that protects the item during transport.

Missing, damaged or improperly protective packaging may result in a reduction in value if this affects the item’s ability to be sold as new. Any such reduction in value may be deducted from the amount refunded upon withdrawal.

You may inspect and test the item in the same way as you would in a physical store, but you may not put it into actual use. If the item is used beyond this, it is considered used, which may result in a full or partial loss of the refund.

Please note that breaches of seals on electronics and software, as well as breaches of seals on liquids, care products and similar items, may constitute a significant reduction in value and, in certain cases, may result in no refund being possible.

Withdrawal from part of the purchase
If you have purchased several items from us, you have the option to return one or more items, even if they were purchased under one order. Please note that you will not get the delivery costs back if you withdraw from part of your purchase. 

If you have obtained free shipping, received a free item, or received other discounts conditional on a purchase above a certain value, and this condition is no longer met after returning part of the purchase, the value of the discount, the gift (if it has not been returned), and/or shipping will be deducted from the amount refunded to you. The shipping amount will most often be DKK 59.

Breaking the seal on sealed products
Delivery of sealed products, audio or video recordings, or computer software whose seal you have broken cannot be withdrawn.

The condition of the item when you send it back in the event of withdrawal.
You are only liable for any decrease in the item's value resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the item. In other words, you may try the item in the same way as if you tried it in a physical store.
If the item has been tried beyond what is described above, we consider it used, which means that if you withdraw from the purchase you will only get part of, or none of, the purchase amount back, depending on the item's commercial value.
To receive the full purchase amount back, you must therefore do the same as you can in a physical store. You may try/inspect the item, but not put it into actual use. If the item has been tried beyond what is stated above, we consider it used, which means that if you withdraw from the purchase you will only get part of, or none of, the purchase amount back depending on the item's commercial value. Please note that if you break the seal on liquids, car care products, and other liquids, this may constitute a reduction in value and in some cases you will only receive DKK 0 back. We therefore encourage you not to break any seals.

Your order must be returned to us without undue delay and no later than 14 days after you have informed us that you wish to withdraw from your purchase. You are responsible for the direct costs associated with returning the item(s). Due to their size/weight, certain items cannot be returned by normal post. This applies to heavy and bulky goods; return costs approx. DKK 1,000/pallet. Return parcels sent cash on delivery to BoatLab.dk will not be collected.

You are responsible for ensuring that the item arrives safely to us, so always remember to pack the item well, and we recommend that you send it as a parcel with Track & Trace (if the parcel should disappear during transport).
You must enclose a copy of your invoice when returning the item. We also encourage you as a consumer to fill out our standard withdrawal form or our online return form.

Refund of the purchase amount
If you cancel your purchase, you will get back the amount you have paid to us, including delivery costs (however, this does not apply to additional delivery costs in cases where you have chosen a different delivery method than the cheapest form of standard delivery that we offer), within 14 days from the day you notify us of this. If you return individual items from your order, we will refund the price of the item; if you return your entire order, we will refund the price of the item/items + standard postage). In the event of deterioration for which you are liable, this will be deducted from the purchase. We will repay using the same means of payment that you chose for the original transaction. We may withhold the refund until we have received the item back,

Uncollected packages/incorrectly specified address
Packages remain at the pickup location for 7 days before they are returned to us.

If you do not pick up the package and it is sent back to us, you will be charged the actual shipping costs for the return shipment. In the event of cancellation, these will be deducted from the amount you would otherwise be refunded. If you want the package resent, you must pay any delivery costs.

If we receive the shipment returned due to an unknown address, or because you have moved from the address, we charge return shipping in accordance with GLS' current prices. If you want the package resent, you must pay any delivery costs.

Privacy policy
We need the following information when you shop with us:

Address
Telephone number
E-mail address

We register and pass on the personal data that are necessary in order to deliver the item to you.
GLS - We pass on name, address, email and telephone number to GLS in order to deliver your package to you and provide you with information about the shipment.
Paymentgateway - They handle the payment solution for us. We therefore pass on your order number and your payment choices (note that we do not have access to your card details!)
Klaviyo - If you sign up for our newsletter in the cart, we pass on your name and email address to Klaviyo. In this way, we can send you relevant newsletters.

The personal data is registered with BoatLab.dk and stored for five years, after which the information is deleted. 
In addition, we cooperate with a number of other companies that store and process data. The companies process information solely on our behalf and may not use it for their own purposes. 

We only work with data processors in the EU or in countries that can provide your information with adequate protection. 

The data controller at BoatLab.dk is Dan Henrik Amilon. 

You have the right to be informed about what information we process about you. 
If you believe that the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you ask us to. This may, for example, be the case if your data is no longer necessary in relation to the purpose for which we needed it. When personal data is collected via our website, we ensure that it is always done with your explicit consent, so that you are informed exactly which information is collected and why.
The manager and employees at BoatLab.dk have access to the information registered about you.

We do not store customer information encrypted.
We do not transmit customer information encrypted.

Information provided to BoatLab.dk is in no way passed on or sold to third parties, and we do not register any sensitive personal information.

Cookies
On BoatLab.dk, cookies are used for the purpose of optimizing the website and its functionality, thereby making your visit as easy as possible for you. You can delete cookies from your computer at any time; how this is done depends on your browser.

Log statistics
We use log statistics on BoatLab.dk, which means that a statistics system collects information that can provide a statistical picture of how many visitors we have, where they come from, and where on the website they leave, etc. The log statistics are used only for the purpose of optimizing BoatLab.dk.

Business purchase terms
These terms apply to business purchases, B2B sales. Here you can read about the right of withdrawal and complaints. For information about shipping, delivery, general information, and payment, see the consumer purchase terms and conditions.

Right of withdrawal
No right of withdrawal is granted for products purchased on BoatLab.dk. 

Right to complain
There is a 1-year complaint period on products purchased on BoatLab.dk. You must complain immediately, and within 2 days after you have discovered the defect. 

We do not issue refunds in connection with a complaint, but we offer extended remediation assistance in the form of repair or similar, provided it is justified. When purchasing on BoatLab.dk, the buyer therefore waives the right to cancel in favor of the seller's extended duty to remedy.

In special cases, if BoatLab.dk assesses that it is reasonable, the buyer may exercise the right to cancel. A deduction for the value of use may apply.

If BoatLab.dk does not remedy the defect within a reasonable time, the buyer may cancel the agreement and receive a refund minus the value of use.
